Company Policies for Private Parties (smaller events)


PAYMENT/REFUND/CANCELLATION POLICY: 

A customer must pay $100 (Deposit) of the booked products and/or services to confirm a reservation.  The remaining balance (Final Payment) must be paid in full, 3 days prior to the scheduled party/event.  The credit card on file will be charged unless the customer pays on or before the due date. All Deposits and Final Payments are non-refundable. 

  

TIPS:  Our staff are there to ensure your group makes the most of the event time. They inspire and entertain. Tipping for good customer service is appreciated. 

 

RESERVATIONS: Customer must be present at the park or event location at least 30 minutes - 1 hour before set-up/delivery unless other arrangements have been made with OC Fun Events. 

 

Permits & Fees: For site locations that require a permit, it is the customer's responsibility to identify and receive the permit. Customer is responsible for all associated permits, fees, rules, and regulations with location.  

 

PLAYERS/GUESTS:  All participating players and guests must be at least 4 years old to participate in Nerf Games and Water Tag.  A minimum of 8 years old to participate in Laser Tag Games. Guests of our play or activity stations, including slime, playdough, tie dye and more are recommended to be at least 4 years old. 

 

WAIVER:  All participants must agree to the following waiver to participate. It is the customer's responsibility to ensure all guests/players have completed the waiver online or in person. 

 

OC Fun Events Waiver: The individual/parent/guardian is responsible for ensuring compliance with these Terms and Conditions. To participate in an OC Fun Events activities, the individual/parent/guardian, the undersigned, agrees and acknowledges that there is risk of injury from these activities and/or from the equipment involved freely assume all such risks, both known and unknown, and assume full responsibility for all participation and their safety. The rules have been read and understood, including all safety-related rules, and I agree to fully comply with all rules and regulations during my participation. On the behalf of my heirs, assigns, personal representatives, and next of kin herby release and hold harmless to Smashvent LLC DBA OC Fun Events and subcontractors, their officers, officials, agents or employees, from any and all liability for injury, disability, death, loss or damage to personal property.  It is acknowledged, understood, and agreed that this release of liability and assume all risk associated with participating. 

 

DELIVERY AND SET-UP FOR ACTIVITIES AND RENTALS: Setup: Activities and Rentals can be set up on grass, turf, concrete, or asphalt. Hills or slight inclines in the setup of area should be a maximum of 5 degrees. This excludes Laser Tag, Nerf Games and Water Tag. Gates and walkways must be a minimum of 5 feet wide for all inflatable or large rentals. 

 

Steps (or Stairs): Customer MUST inform OC Fun Events of any steps (or stairs) present to the setup area. If steps surpass the maximum allowed (10 steps) there will either be a Delivery Fee applied or a reservation will be canceled, and a cancellation fee will be applied. 

 

Food/Drink: OC Fun Events do not allow any food or drinks into the play activity area including Laser Tag, Nerf Game, Water Tag Play, Inflatables, and Activity Stations. Please have your guests consume them outside of the areas in which the activity and rentals are located. 

 

Water/Sand: For Laser Tag and Nerf Games, water and sand damage our equipment, location for activities and rentals must be away from both elements. 

 

Site Preparation: The customer must make sure the setup area is ready (i.e. lawns mowed, vehicles/obstacles out of the way, animal feces removed, setup location cleared) before the staff/driver is scheduled to arrive. If the setup area is not ready or accessible when the staff/driver arrives, or if rented products cannot be moved directly to the area (extra handling involved) the customer may be charged an additional delivery fee. If the setup area is not prepared, the staff/driver might be forced to leave and/or reschedule your delivery later, in which case a delivery fee will be applied. OC Fun Events is not responsible for damage, alterations, or cosmetic changes to surface areas caused by our activities or rented products set up for any amount of time. Inflatables may ruin grass or turf. If there is a concern about the setup area being damaged or altered, please choose a cement setup area as a setup location. Underground Utilities: The customer assumes responsibility for any damage to underground utilities, landscaping, water lines resulting from product setup. Smashvent LLC dba OC Fun Events and/or hired subcontractors do not assume responsibility for utilities damaged by installation. Please be ready to inform the driver of the existence of any underground utilities (i.e. sprinkler systems, phone lines, gas lines, septic system, etc.), that may interfere with the ability to stake and/or anchor products. It is recommended you contact DIG ALERT at 8-1-1 or 800-422-4133 before our arrival to be informed of any underground utilities in your area. OC Fun Events will not be liable for damages to private or city/county property if the customer, or person coordinating on behalf of the customer, does not notify the staff/driver where to or not to anchor the rented products. 

 

NOTE: If the staff/driver is not able to set up the activity(s) and/or rental item(s) because of the customer's negligence to inform of any steps, suitable surface, or access requirements then OC Fun Events will have to cancel the order as "Undeliverable" and a delivery/cancellation fee will be charged. 

 

DELIVERY AND PICK-UP FOR RENTALS ONLY: Reservation Length: All rental reservations are for an 8-hour period. Deliveries are made between 8 am and your desired delivery time and pickups are made from your desired pickup time up to 3 hours after. We strive to be on time for all customers, therefore we require a window time of 1-3 hours for Delivery and Pickup. Our drivers make their best effort to accommodate your desired delivery and pickup times, but because of traffic and unexpected events, the times are Not Guaranteed. 

 

Delivery: Delivery times should be arranged about 1-2 hours before the start of your event. Customer must be present for delivery and pick-up.   

 

Pickup: Pickups will begin from your requested time, and not before, but may range up to 3 hours. 

 

BAD WEATHER:  There may be occasions when the weather does not want to cooperate with your scheduled event. In the event of severe weather (lightning, high winds, flooding and/or extremely heavy rains) we may (and reserve the right to) reschedule your service to guarantee the safety of you, your guests, our staff, and equipment. You must contact our business at least 5 days before your event, to reschedule or move to an indoor/covered location. You may reschedule up to one year from the previously scheduled event. Additional charges may apply. 

  

UNSUPERVISED MINORS:  We are not responsible for supervising any minors or attendees at the parties. OC Fun Events does require a parent, responsible adult or appointed responsible party to be present should a need to contact them arise, for guests 16 and under. 

 

ALCOHOL/DRUGS:   You may serve alcohol at your event or party; however, we reserve the right to refuse, cancel or cut short any party or booking when alcohol is being served when it interferes with the party. Drugs of any sort will not be tolerated in or around the OC Fun Events equipment. Any observed use of illegal or legal narcotics used in an illegal manner will result in the party's termination immediately. 

  

ADDITIONAL REQUIREMENTS:  Insurance: Any additional fees, permits, license, endorsements, or requirements will be billed to the customer. Any additional insurance requirements are an added fee of a minimum of $35. Our company has a current $1M General Liability Insurance policy. If your company/organization requires any additional requirements, policies or insurance, then these need to be made aware to our company at the time of reservation- all additional fees will apply and added to the event contracted amount.   

 

Electricity: A minimum 4000-watt generator is required for all large inflatables going to a park unless the park facility provides electricity, and the customer has ensured there will be a dedicated 15 AMP circuit available. Please contact OC Fun Events to make sure you reserve the correct number of generators. The Blow-up Dart Board and 5 in 1 Carnival Game rental includes generators.   

 

Water Products: Water products require a regular garden water hose that is the necessary length to be connected at the set-up area. Supplied by the customer within range of the setup area. Garden water hoses are not provided by OC Fun Events and/or hired subcontractors. Water Slides DO NOT come with any mats or cushions to be placed under the pool area for when users slide down. If a customer wishes to place mats for extra cushions, they must provide them during delivery to the staff/driver.   

 

RELEASE OF LIABILITY: Customer (Business/Organization) agrees to hold FULL responsibility in ensuring safe operation of OC Fun Events and/or subcontractors, to follow any safety rules posted for Activity(s) and/or Rental(s) and/or verbally given, and to supervise the Activity(s) and/or Rental(s) and any and all participants. Customer understands and acknowledges that any activity in connection to Product(s) brings both known and unanticipated risks that could result in property damage, physical or emotional injury, paralysis, death or other damage or injury to participants. Those risks include but are not limited to falling, slipping, crashing and colliding. Customer understands such risks cannot be eliminated without jeopardizing the essential qualities of the activity. Customer agrees to release, forever discharge and hold harmless Smashvent LLC dba OC Fun Events and/or subcontractors, including its officers, employees, subcontractors and/or agents from any injury, damages or claims that result from Customers negligence including any injuries, claims or damages asserted by Customers guests, invitees or third parties. Customer agrees to report any damage, injury or claim to OC Fun Events and/or subcontractors within five (5) days of the reservation date; failure to do so will result in negligence from Customer and release of any liability or responsibility from OC Fun Events and/or subcontractors' equipment. 

 

Further, Customer agrees not to hold OC Fun Events and/or subcontractors, including its officers, employees, subcontractors and/or agents liable or accountable for any costs arising out of or in connection to attorney's fees and/or claims brought up in court involving the use of any Product(s). Customer shall indemnify and hold harmless OC Fun Events and/or subcontractors, its employees, executives and agents from and against any and all damages, liabilities, claims, costs, expenses, attorney's fees, etc. incurred by Customer directly or indirectly, in connection with the rental of Product(s) due to negligence of OC Fun Events and/or subcontractors. 

 

DISPUTE RESOLUTION: The parties agree to mediate any dispute or claim arising between them out of this Agreement, or any resulting transaction, before resorting to arbitration. Mediation can be commenced by one party demanding it of the other. Mediation fees, if any, shall be divided equally among the parties. If any party commences an action without first attempting to resolve the matter through mediation or refuses to mediate within 30 days after a request has been made, then that party shall not be entitled to recover attorney’s fees, even if they would otherwise be available to that party in any such action. Any controversy or claim remaining unresolved after mediation shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any party filing a complaint in a court of law which is ruled to be properly venued in arbitration may, at the discretion of the arbitrator, owe the other party for any attorney's fees incurred for moving it properly to arbitration. 

 

PRIVACY POLICY: OC Fun Events is committed to protecting your privacy. We use the information we collect on the site to make bookings as simple as possible and to enhance your overall experience. We do not sell, trade, or rent your personal information to others. 

 


Company Policies for Large Events


PAYMENT/REFUND/CANCELLATION POLICY: 

A customer must pay 25% (Deposit) of the booked products and/or services to confirm a reservation of a large party ($1,000 and over). The remaining 75% (Final Payment) must be paid in full 10 calendar days before the scheduled event.  If we need to cancel the event, we will make every effort to postpone your event, with no penalty; another date should postponement be necessary, up to one year from your previously scheduled event. All deposits are non-refundable. If cancelled 30 days or less to the date of the event, 50% cancellation fee of total amount due. Unless prior payment schedules have been arranged. No refund is provided.

Inflatable water slides are not engineered to flow water like waterparks. Water pressure needs to be low to function properly AND prevent flooding in backyards.
